Terms of Service

The rules governing your access to and use of the SwaziSwap platform.

These Terms of Service ("Terms") govern your access to and use of the SwaziSwap platform, including our website, mobile applications, and related services (collectively, the "Platform").

By using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

Definitions

Buyer
Any user purchasing goods or services through the Platform.
Seller
Any third-party merchant offering goods or services through the Platform.
Merchant of Record
SwaziSwap is the entity that processes payments from Buyers and issues refunds.
Platform
The SwaziSwap website, mobile applications, and related services.
Order
A purchase transaction initiated by a Buyer through the Platform.

SwaziSwap processes payments from Buyers, holds funds, and disburses payments to Sellers according to the Seller Agreement and weekly payout schedule.

Account Registration

You must create an account to use certain features of the Platform. You agree to provide accurate, current, and complete information and to keep your account credentials secure.

You are responsible for all activity conducted through your account.

Orders and Payments

All payments are processed by SwaziSwap as Merchant of Record. By placing an order, you authorise SwaziSwap to:

  • Charge your selected payment method;
  • Hold funds until order completion or resolution; and
  • Process refunds where applicable.

Prices, taxes, and fees are displayed at checkout and may include platform service fees. Accepted payment methods include MTN MoMo, debit/credit card, and cash on delivery (COD).

Taxes and VAT

SwaziSwap is responsible for collecting and remitting applicable taxes, including Value Added Tax (VAT), in accordance with the laws of the Kingdom of Eswatini, including the Value Added Tax Act, 2011 and any amendments thereto.

Where applicable, Sellers agree that SwaziSwap may calculate, collect, and remit taxes on their behalf and deduct such amounts from Seller payouts.

Logistics and Fulfilment

SwaziSwap manages all logistics for orders placed through the Platform. This includes collecting items from Sellers and delivering them to Buyers via SwaziSwap drivers.

  • Sellers are responsible for preparing items for collection at their registered dispatch location within the agreed timeframe.
  • SwaziSwap arranges and manages all collection and delivery.
  • Delivery timelines are estimates and not guarantees.
  • SwaziSwap may monitor fulfilment performance and take corrective action where necessary.

Delivery fees are calculated based on road distance from the Seller's dispatch location to the Buyer's delivery pin, using real-time routing. Fees are shown in full at checkout before payment.

Returns and Refunds

Refunds are processed by SwaziSwap in accordance with the Returns & Refund Policy. SwaziSwap may deduct refunded amounts from Seller payouts where the Seller is responsible for the issue.

Buyers may submit return requests within 7 calendar days of delivery. Full details are set out in the Returns & Refund Policy.

Seller Payouts

Sellers receive payouts on a weekly schedule, subject to:

  • Order completion;
  • Dispute resolution;
  • Platform fees and commissions; and
  • Refund or chargeback deductions.

Full details are governed by the Seller Agreement.

User Conduct

You agree not to engage in any of the following:

Violate any law or regulation

Engage in fraud, abuse, or deception

Upload prohibited or infringing content

Interfere with Platform security or operations

SwaziSwap may suspend or terminate accounts for violations of these Terms without prior notice.

Intellectual Property

All Platform content, trademarks, and technology are owned by SwaziSwap or its licensors. You may not copy, modify, distribute, or exploit Platform content without express written permission.

Limitation of Liability

To the fullest extent permitted by law, SwaziSwap is not liable for:

  • Indirect, incidental, or consequential damages;
  • Seller performance or product defects (except where required by law); or
  • Delays, interruptions, or technical failures.

Total liability shall not exceed the amount paid for the relevant order.

Indemnification

You agree to indemnify and hold SwaziSwap harmless from claims arising from your use of the Platform, your violation of these Terms, or — in the case of Sellers — any Seller-side violations.

Termination

SwaziSwap may suspend or terminate access at any time for violations or legal reasons. Users may close their accounts at any time.

Governing Law

These Terms are governed by the laws of the Kingdom of Eswatini, without regard to conflict of law principles. Any legal proceedings shall be subject to the jurisdiction of Eswatini courts.

Changes to Terms

SwaziSwap may modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
